READ THIS CAREFULLY. These Terms contain a binding arbitration clause and class-action waiver (Section 17), broad limitations of our liability (Sections 13–14), and your agreement to indemnify us (Section 15). By using the Site you agree to all of it.
1. Acceptance of These Terms
By accessing, browsing, registering for, or using the Platform in any way, you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy and Community Guidelines, which are incorporated here by reference. If you do not agree, do not use the Platform.
If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
2. Who May Use the Platform (Eligibility & Age)
- You must be at least 18 years old to create an account or use the Platform. The Platform is intended for adults and is not directed to anyone under 18.
- By using the Platform you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.
- We may require age or identity verification at any time and may suspend access pending verification.
- The Platform is operated from the United States. If you access it from elsewhere, you are responsible for compliance with your local laws, and you agree your data may be processed in the U.S.
Note: If the Platform hosts adult/explicit content, age-gating obligations are increasing rapidly under state laws (e.g., age-verification statutes). Have counsel confirm what verification you must implement for the states you serve.
3. The Nature of This Platform (“Uncensored”)
The Platform is designed to support a wide range of speech and expression with minimal editorial interference. However, “uncensored” does not mean “anything goes.” There are firm limits, set out in Section 6, that exist to keep the Platform legal and operational. We reserve the absolute right, in our sole discretion and without notice, to remove any content and to suspend or terminate any account for any reason or no reason — including content that is lawful but that we determine harms the Platform, its users, our service providers, or us. Retaining this discretion is essential and you expressly agree to it.
4. Your Account
- You are responsible for all activity under your account and for keeping your credentials secure.
- You agree to provide accurate information and to keep it current.
- You may not share, sell, or transfer your account, impersonate others, or create accounts to evade a ban.
- Notify us immediately at owner@thedistillerynetwork.com of any unauthorized use.
5. Your Content and the License You Grant Us
“User Content” means anything you post, upload, stream, transmit, or otherwise make available on the Platform.
- You keep ownership of your User Content.
- You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (e.g., for formatting/transcoding), display, distribute, and otherwise use your User Content solely to operate, provide, promote, and improve the Platform. This license ends when you delete the content or your account, except to the extent (a) content was shared with others who have not deleted it, (b) we are required to retain it by law, or (c) it persists in backups for a reasonable period.
- You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate these Terms or any law or third-party right.
- We do not pre-screen User Content and are not obligated to monitor it. We are not responsible for User Content, and you rely on it at your own risk. You understand you may encounter content you find offensive, indecent, or objectionable.
6. Prohibited Content and Conduct (The Hard Limits)
Even on an uncensored platform, the following are strictly prohibited. There are no exceptions for the items in 6(a). Violations may result in immediate removal, account termination, preservation of evidence, and reporting to law enforcement.
6(a) — Zero-Tolerance / Illegal Content
You may not post, request, link to, or facilitate:
- Child sexual abuse material (CSAM) or any sexualized content involving minors, including drawn, animated, AI-generated, or “fictional” depictions, and any content that grooms, solicits, or endangers a minor. We report all such material to the NCMEC CyberTipline and to law enforcement, and we preserve associated records.
- Sex trafficking or content that promotes or facilitates prostitution or trafficking (consistent with FOSTA-SESTA, 18 U.S.C. § 1591, § 2421A).
- Non-consensual intimate imagery (“revenge porn”), including content created or altered (e.g., deepfakes) and shared without the depicted person’s consent.
- True threats of violence, incitement to imminent lawless action, or content that solicits, plans, or celebrates terrorism or mass violence.
- Content that promotes or facilitates terrorism or that provides material support to designated terrorist organizations.
- Sale or facilitation of clearly illegal goods or services (e.g., illegal weapons or weapon-conversion devices, controlled substances, stolen data/credentials, fraudulent documents).
- Doxxing — publishing another person’s private identifying information with intent to harass, intimidate, or facilitate harm.
- Malware, exploits, phishing, or content designed to compromise systems or accounts.
- Any content or conduct that violates applicable U.S. federal, state, or local law.
6(b) — Other Prohibited Conduct
You also may not:
- Infringe copyrights, trademarks, patents, trade secrets, or other intellectual-property or privacy rights (see Section 7).
- Engage in coordinated harassment, stalking, or targeted abuse of an individual.
- Post spam, run unauthorized bots, scrape the Platform, or artificially manipulate engagement.
- Attempt to circumvent security, access areas you’re not authorized to, reverse engineer, or overload/disrupt the Platform.
- Misrepresent your identity to deceive or defraud others.
- Use the Platform in a way that exposes us to legal liability or jeopardizes our relationships with payment processors, hosts, or app stores.
We may add to, refine, or interpret these rules in our Community Guidelines. Where the Guidelines and these Terms conflict on prohibited content, the broader prohibition controls.
7. Copyright / DMCA Policy
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) and maintain a policy of terminating repeat infringers.
To submit a takedown notice, send the following to our Designated Agent: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and its location (URL); (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act.

Important: To receive DMCA safe-harbor protection you must register a Designated Agent with the U.S. Copyright Office (copyright.gov/dmca-directory) and implement a real repeat-infringer policy. Do this before launch.
We will forward valid notices, may remove the material, and will accept counter-notices as provided by § 512(g).
8. Reporting and Enforcement
- Users can report content that violates these Terms via owner@thedistillerynetwork.com.
- We may investigate, remove content, restrict features, suspend, or terminate accounts at our discretion. We are not obligated to act on every report, to act consistently, or to explain our decisions, though we may offer an appeal process at our discretion.
- We may preserve and disclose content and account information when we believe in good faith it is necessary to comply with law, enforce these Terms, respond to legal process, or protect the rights, safety, or property of anyone.
9. Our Intellectual Property
The Platform itself — software, design, logos, trademarks, and our original content — is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Platform for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Platform without our written permission.
10. Third-Party Content, Links, and Services
The Platform may contain links to or integrations with third-party sites and services we do not control. We do not endorse and are not responsible for them. Your dealings with third parties (including payment processors and advertisers) are solely between you and them.
11. Payments, Subscriptions, and Virtual Items (If Applicable)
If we offer paid features: prices, billing cycles, and refund terms will be disclosed at purchase. Unless required by law or stated otherwise, all sales are final and non-refundable. We may change pricing prospectively. You authorize us and our payment processors to charge your payment method for amounts you incur.
12. Termination
- By you: You may stop using the Platform and delete your account at any time.
- By us: We may suspend or terminate your access at any time, with or without cause or notice.
- Effect: Upon termination, your license to use the Platform ends. Sections that by their nature should survive — including 5 (license already granted to existing shared content), 6, 9, 13, 14, 15, 16, 17, and 18 — survive termination.
13. Disclaimers of Warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of harmful components, or that any User Content is accurate, lawful, or reliable. You assume all risk arising from your use of the Platform and from any User Content you encounter. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Platform or any User Content.
- Our total aggregate liability for all claims relating to the Platform will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100.
- These limits apply regardless of the legal theory and even if we were advised of the possibility of such damages. Some jurisdictions limit these exclusions, so some may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless us and our owners, members, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Platform; (c) your violation of these Terms or any law; or (d) your violation of any third party’s rights. We may assume exclusive defense of any matter subject to indemnification, and you agree to cooperate.
16. Section 230 and Our Role as a Service Provider
The Platform is an interactive computer service within the meaning of 47 U.S.C. § 230. We are not the publisher or speaker of User Content provided by others, and we are not liable for it. Our removal, restriction, or moderation of any content — or our decision not to remove content — does not make us the publisher of, or responsible for, any User Content, and we retain full discretion over moderation as described in Sections 3 and 8.
17. Dispute Resolution — Arbitration and Class-Action Waiver
PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS.
- Informal resolution first: Before filing anything, contact us at owner@thedistillerynetwork.com and give us 30 days to resolve the dispute.
- Binding arbitration: Except as noted below, any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its applicable rules, conducted in Hillsborough County, New Hampshire or by video/telephone. The Federal Arbitration Act governs interpretation of this section.
- Class-action waiver: Disputes will be brought only in your individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.
- Exceptions: Either party may bring claims in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-access claims in court.
- Opt-out: You may opt out of arbitration by emailing owner@thedistillerynetwork.com within 30 days of first accepting these Terms, stating your name and intent to opt out.
Arbitration and class-waiver enforceability varies by state and is litigated frequently. Have counsel tailor and confirm this clause.
18. Governing Law
These Terms are governed by the laws of the State of New Hampshire and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to Section 17, the exclusive venue for any permitted court action is the state and federal courts located in Hillsborough County, New Hampshire, and you consent to their jurisdiction.
19. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will update the “Last Updated” date and may provide additional notice (e.g., on the Site or by email). Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Platform.
20. General
- Entire agreement: These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and us regarding the Platform.
- Severability: If any provision is held unenforceable, the rest remain in effect, and the unenforceable provision is modified to the minimum extent necessary.
- No waiver: Our failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms; we may assign them freely (e.g., in a merger or sale).
- No agency: Nothing here creates a partnership, employment, or agency relationship.
- Force majeure: We are not liable for failures caused by events beyond our reasonable control.
- Headings are for convenience only.
